This article delves into the multifaceted human rights challenges confronting migrant women in Botswana, with a particular focus on women from Zimbabwe. The exploration reveals pervasive gender-specific barriers hampering these women’s access to essential healthcare and decent employment opportunities. Additionally, it sheds light on their heightened susceptibility to gender-based violence, exploitation, and discriminatory practices in the workplace, all of which collectively infringe upon their fundamental right to dignity. Central to the argument is the imperative to safeguard and uphold the right to dignity for Zimbabwean migrant women. This necessitates the establishment of an environment that not only guarantees access to basic human needs but also fosters a space free from fear and abuse. The article advocates for the implementation of a “Migration with Dignity Framework” in Botswana. This proposed framework emphasizes the critical importance of gender-sensitive policies, robust access to justice mechanisms, non-discrimination initiatives, and the assurance of healthcare, secure working conditions, and adequate housing.

This article explores a different perspective on the right to dignity of the surrogate mother in commercial surrogacy arrangements under international human rights norms and philosophical principles. Here, I examine the concept of human dignity under the lenses of contemporary legal theory reflecting on the right to self-determination of the surrogate mother. This dignity-based approach serves for analysing how International Human Rights Law enables women to enter commercial surrogacy agreements on the basis of their contractual freedom, their reproductive rights, on the prohibition of non-discrimination and their labour rights. Under the lenses of economics and law, I examine how this practice carries the potential to empower the economic emancipation of women and their access to the labour market. Dignity as rights-constraining will reflect on the other side of surrogacy. I investigate the exploitative character of this practice and how it could present human rights abuses for the surrogate mother. Specifically, I focus my analysis on how surrogacy contracts could violate the bodily autonomy of the surrogate and potentially maintain gender inequality and reinforce gender stereotypes. After recognizing certain concerning aspects of individual surrogacy arrangements, I question whether outlawing surrogacy is the right response to this practice.

The right to dignity is fundamentally linked to the human being. Any breach thereof must give the holder the opportunity to repair the prejudice caused. Most of the time the prejudice is primarily non-patrimonial, which makes it more difficult to remedy. The right of reply gives the interested party a non-patrimonial remedy of the dignity through the possibility of restoring his/her reputation by presenting his/her variant of truth. The purpose of this paper is to highlight the importance of granting the right of reply in the shortest possible time and through the fastest possible means, including through provisional measures. Its recognition at the legislative level only in the field of audio-visual communications is not sufficient, but may represent a starting point for its extension in the civil law. The lack of an express regulation in civil matter does not, however, impede its granting, but the observance of some conditions specific to the civil means of protection of the personality rights is required, and the time elapsed until its exercise is longer and the reply may become inconsiderable. Reparation by equivalent cannot fully restore the right to dignity, which is why the legislative recognition in civil law of the right of reply is required as a personality right in the interest of the individual's self-determination regarding the public presentation of his/her person.

The lack of affordable housing for people with low income, shrinking public resources, and new political conflicts threaten the availability of housing, at the same time as aggressive forms of urban renewal are causing displacement through ‘renoviction’, putting tenants in critical situations. In this article, we focus on the acts of resistance and new social organization trends that have emerged in relation to the praxis of renoviction used by landlords and other local authorities, and the frustration caused by this praxis. We claim that these new forms of organization are using the concept of renoviction in articulating current struggles for housing justice. Methodologically, we point out the necessity of urban research conducted in close collaboration with activism, as a way for mutual learning and support. Moreover, we suggest that these acts of resistance should be understood as happening within a broader context of economic and political changes affecting the housing market, and in relation to the increased racialization of poverty and territorial stigmatization in Swedish cities. To illustrate and then strive to understand the ongoing resistance and demands for housing justice, we focus on national activist networks emerging in response to the neoliberal housing crisis. We maintain that emerging resistance in Stockholm, Gothenburg, and Uppsala represents a growing claim for housing justice. This resistance is based on people’s everyday lives and is a cry for dignity in neighborhoods neglected by housing companies.

Different medically based constructions of Attention Deficit Hyperactivity Disorder (ADHD) have been around since ‘mental restlessness’ in 1798, evolved through the 20th century with ‘minimal brain dysfunction’ and distinctions between Attention Deficit Disorder (ADD) and ADHD (DSM-III), to current presentations of ADHD (DSM5). As new insights and knowledge have become available, the meaning and labels attached to ADHD have changed, and so they are malleable. This piece will explore two different labels (or frameworks for meaning) for the cluster of behaviours and difficulties associated with the phenomenon known as ADHD; that is, the disorder label and the diversity label. These labels will be explored in terms of accuracy and consequences, particularly their impact on human dignity. Problems inherent in the disorder label will be critically considered, particularly how accurate it is given that psychobiological differences should not be viewed as disorder, may not ‘cause’ functional deficits, and may be understood as strengths. These problems call the disorder label into question, and suggest that ADHD-type behaviours could be understood as traits. This piece will also call into question taken-for-granted social structures that could contribute to or be responsible for the difficulties associated with ADHD, in particular, the stigmatisation of the ADHD label and socio-cultural norms and expectations around ADHD-type behaviours. An alternative diversity label, the neurodiversity framework (or Attention Deficit Hyperactivity Diversity) will be explored, in terms of whether it applies to ADHD and the opportunities it offers for empowerment of people and the protection of their fundamental human dignity. In essence, this piece is a socio-political debate about identity; about the labels that can inadvertently harm human dignity and prevent other human rights. It is also about people’s right to choice and autonomy in their identity and ways of being in this world. These are human rights issues, because identity is about one’s inherent worth and dignity, and human dignity is the basis for human rights.

A retributive and punitive approach is normally adopted in dealing with misbehavior in South African schools. Despite the legal abolition of corporal punishment, more than 50 percent of schools still administer it. Other forms of punishment generally applied are also punitive in nature. The right to dignity of all of the parties affected by misbehaviour in schools is considered in this analysis. The possibility of adopting restorative justice as an alternative disciplinary approach is examined as a way of protecting, promoting and restoring the dignity of the victims of such misbehaviour.

Fleur Johns' thesis about the increasing role of data in the verification of the condition of the world and how this impacts on international law is stimulating and bears reflection. This is an extremely interesting and innovative approach to the issue of data and its role in state engagement with mass migration. From the perspective of a scholar on international refugee law, a number of issues arise as a result of the analysis. One of the contested aspects of mass migration and refugee protection is the inherent inconsistency between two ways of thinking about human rights—the first is the duty of (some) international organizations to protect human rights in a manner which elides human rights and humanitarian law, and the second is the right of the individual to dignity, the basis of all human rights according to the UN's Universal Declaration of Human Rights of 1949. The first enhances the claims of states to sovereign right to control their borders (mediated through some international organizations), while the second recognizes the international human rights duties of states and international organizations to respect the dignity of people as individuals (including refugees). Fleur is completely correct that human rights abuses are at the core of refugee movements. While there are always many people in a country who will stay and fight human rights abuses even when this results in their sacrifice, others will flee danger trying to get themselves and their families to places of safety; we are not all heroes. Yet, when people flee in more than very small numbers, state authorities have a tendency to begin the language of mass migration. The right to be a refugee becomes buried under the threat of mass migration to the detriment of international obligations. Insofar as mass migration is a matter for management, the right of a refugee is an individual right to international protection which states have bound themselves to offer.
