This book attempts to analyse the concept of religious expression vis-à-vis freedom of speech in Malaysia from the philosophical, political and theoretical perspectives. Taliban's return to power in August of 2021 caused everyone to ask why the two decades of institution building in Afghanistan failed. This book investigates the root causes of failed reforms in an important area of reform: trade and credit institutions. It explains why the efforts to reform and regulate the economic institutions in Afghanistan failed and what we can learn from their failure. It draws on more than eighty interviews with Afghan merchants, business leaders, money dealers, and government officials in five major provinces of Afghanistan to identify the barriers to access to credit and to understand the performance of formal institutions (banks) and their informal counterparts. This book finds that Afghan merchants were often unable to benefit from the offerings of formal institutions for three reasons: a highly volatile business climate, uncertain contract enforcement, and an unsupportive property rights system. Several informal institutions have emerged that alleviate some of the credit constraints on Afghan merchants. These informal institutions include risk-sharing trade credit operations, money dealers'short-term working capital loans, Gerawee, and Sar qufli. Although these informal institutions have helped Afghan merchants survive, they are unable to support economic growth. This book argues that countries like Afghanistan should solve their institutional dilemma by adopting an approach which the author calls'Grounded Institutional Reform.'Using this approach, a country would formalize existing informal institutions, a development that would vastly increase their effectiveness. While this book focuses on credit and trade in Afghanistan, the analysis of'formalizing the informal'can easily be extended to solve other types of economic problems in similarly situated countries. This book should be of great interest to scholars, policymakers, and development workers in the field of law, finance, and development.

Using primarily Urdu sources from the nineteenth century, this book allows us to rethink notions of'the Muslim', in its numerous, complex and often contradictory forms, which emerged in colonial North India after 1857. Allowing the self-representation of Muslimness and its manifestations to emerge, it contrasts how the colonial British'made Muslims'very differently compared to how the community envisaged themselves. A key argument made here contests the general sense of the narrative of lamentation, decay, decline, and a sense of self-pity and ruination, by proposing a different condition, that of zillat, a condition which gave rise to much self-reflection resulting in action, even if it was in the form of writing and expression. By questioning how and when a Muslim community emerged in colonial India, the book unsettles the teleological explanation of the Partition of India and the making of Pakistan.

Kashmir remains one of the world's most militarized areas of dispute, having been in the grips of an armed insurgency against India since the late 1980s. In existing scholarship, ideas of territoriality, state sovereignty, and national security have dominated the discourses on the Kashmir conflict. This book, in contrast, places Kashmir and Kashmiris at the center of historical debate and investigates a broad range of sources to illuminate a century of political players and social structures on both sides of divided Kashmir and in the wider Kashmiri diaspora. In the process, it broadens the contours of Kashmir's postcolonial and resistance history, complicates the meaning of Kashmiri identity, and reveals Kashmiris'myriad imaginings of freedom. It asserts that'Kashmir'has emerged as a political imaginary in postcolonial era, a vision that grounds Kashmiris in their negotiations for rights not only in India and Pakistan, but also in global political spaces.

The long standing controversy among various group of ulamaa on the issue of'triple talaq'once again has become a burning issue and is hotly debated. A fatwa (juristic verdict) on the issue which appeared before the national press flared up the controversy. Last year three Muftis of Jamat Ahl-i Hadith, according to their Maslak (Law), gave a verdict holding three pronouncements of talaq, all together at single sitting as not to be considered effective under Shariah which requires an interval of one month between one pronouncement and the other, as the procedure of talaq, as mentioned in the Quran. On April 15, justice H.N. Tilhari of the Lucknow bench of Allahabad High Court pronounced that the practice of uttering the word'Talaq'at one go to effect an'irrevocable'divorce was both unconstitutional and illegal. This judgement worked as fuel to fire and increased the intensity of the debate. The book does not go into the intricacies of the contents of the judgement. But the view of Ahl-i Hadith ulamaa which is known to all on the issue is indeed thought-provoking for our Hanafi ulamaa of the time. The object of the present study is to examine afresh the longstanding controversy over this topic and to seek a solution acceptable to people of divergent views. The work is based on primary books of Islamic jurisprudence and primary source of Islamic fiqh are consulted to present the true picture of law on the subject. The book would be useful not only for students and researchers of Islamic law but will also help lawyers and judges in dealing with cases according to the letter and spirit of Shariah.

The German lacuna in Edward Said's'Orientalism'has produced varied studies of German cultural and academic Orientalisms. So far the domains of German politics and scholarship have not been conflated to probe the central power/knowledge nexus of Said's argument. Seeking to fill this gap, the diplomatic career and scholarly-literary productions of the centrally placed Friedrich Rosen serve as a focal point to investigate how politics influenced knowledge generated about the “Orient” and charts the roles knowledge played in political decision-making regarding extra-European regions. This is pursued through analyses of Germans in British imperialist contexts, cultures of lowly diplomatic encounters in Middle Eastern cities, Persian poetry in translation, prestigious Orientalist congresses in northern climes, leveraging knowledge in high-stakes diplomatic encounters, and the making of Germany's Islam policy up to the Great War. Politics drew on bodies of knowledge and could promote or hinder scholarship. Yet, scholars never systemically followed empire in its tracks but sought their own paths to cognition. On their own terms or influenced by “Oriental” savants they aligned with politics or challenged claims to conquest and rule.
