Treuhandbeteiligungen, Grundstückstreuhand, Treuhandkonten, Vermögensverwaltung, Inkassotätigkeit, Sicherheitenpools und andere Fälle einer Doppeltreuhand, Konsortial-, Anleihe- und Refinanzierungstreuhand, unselbstständige Stiftungen und vieles mehr: In keinem dieser Anwendungsfälle einer Verwaltungstreuhand sind die Probleme ihrer rechtlichen Behandlung im Außenverhältnis und ihrer Unterscheidung von anderen Formen der Treuhand, insbesondere der Sicherungstreuhand, bislang befriedigend gelöst. Stefan J. Geibel setzt den bisher in Rechtsprechung und Literatur befürworteten Lösungsansätzen, die an einer wirtschaftlichen Betrachtungsweise, am Unmittelbarkeitsgrundsatz oder an anderen Grundsätzen anknüpfen, eine dogmatische Neuorientierung entgegen: Er qualifiziert die Verwaltungstreuhand als eine atypische, rechtsgeschäftlich nach §§705ff.
