Abstract

This curriculum guide presents a context for preservice education and/or professional development in education law for teachers. Section 1, "Teacher Liability," discusses "Duty to Supervise,""Providing Reasonable Care,""Duty,""Preventing Student-to-Student Sexual Harassment,""Reporting Child Abuse,""Issuing Permission Slips,""Defense for Liability,""Acting as a Reasonable Person,""Contributory Liability,""Strict Liability," and "Availability of Liability Insurance." Section 2, "Student Rights," focuses on "Freedom of Expression,""Pledge of Allegiance,""Prayer,""Fighting Words,""Student Searches,""Constitutional Due Process,""Family Education Rights to Privacy Act (FERPA)," and "Students with Disabilities: The Right to Appropriate Education." Section 3, "Teacher Rights," discusses "Freedom of Expression (Personal Views)" and "Religious and Political Association." Section 4, "Academic Freedom," includes "Obligation to School District/State Curriculum" and "Use of Supplementary Materials." Section 5, "Teacher Conduct," includes "Language;""Harassment;""Corporal Punishment;""Fair Labor Standards, Hiring, and Promotion Policy;""Medical Policy;""Dress and Grooming;""Lifestyle Choices;""Students with AIDS;""Academic Sanctions;""Sexual Misconduct with Students;""Marriage and Pregnancy;" and "Extracurricular Participation." Section 6, "Teacher Termination," includes "Probationary Teachers" and "Teachers with Tenure."
