Estudio de caso sobre derecho de igualdad de madres gestantes en Sentencia 3-19-20-JP en Ecuador

The general objective of the research was to make a legal analysis of the case study on the right to equality of pregnant mothers in Judgment 3-19-20-JP in Ecuador. The method used was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The research technique was the interview; the tool or instrument that supported it was the structured interview guide which was applied to legal professionals, specialized in the constitutional area, who gave informed consent to participate in this study. According to the analysis of sentence No. 3-19-20-JP of the Constitutional Court, it is concluded that there should be equal conditions for working pregnant mothers; all of them should be protected by the maternity leave regardless of the type of contract under which they provide their services. According to most of the interviews conducted, there IS an affectation of the right of pregnant mothers.
El objetivo general de la investigación fue analizar jurídicamente el estudio de caso sobre derecho de igualdad de madres gestantes en Sentencia 3-19-20-JP en Ecuador. El método empleado, se basó en el enfoque cualitativo, manejando la recolección y análisis de una tipología documental-bibliográfica. La técnica de investigación fue la entrevista; la herramienta o instrumento que apoyó fue la guía de entrevista estructurada la cual fue aplicada a profesionales del derecho, especializados en el área constitucional, quienes dieron el consentimiento informado para participar en el presente estudio. Según el análisis de la sentencia Nº 3-19-20-JP de la corte constitucional se concluye que debe existir una igualdad de condiciones para las madres gestantes trabajadoras; todas ellas deben estar protegidas por el fuero de maternidad indiferentemente del tipo de contrato bajo el cual prestan sus servicios. De acuerdo con la mayoría de las entrevistas realizadas, SÍ existe afectación al derecho de madres gestantes.
