Informe pericial psicológico: trastorno del control de los impulsos e incapacidad civil (curatela)

Currently, the limiting of civil ability is regulated in Spanish law by Articles 199 and the following articles of the Civil Code, after the reformation of this legal text via Law 13/83 of October 24, 1983. This was an attempt by the legislator to promote the functions of protection of the rights of handicapped people and at the same time, to offer them the maximum assurance that they will be able to defend and exercise their rights. Thus, Article 199 of the Civil Code states that "No one can be declared incapable except by a judicial sentence due to the causes established by law" and this legal concept is complemented by Article 200, which establishes that "diseases and persistent deficiencies of a physical or psychological nature that prevent the person from controlling him or herself are cause for incapacitation." In this article, we present a model of an expert report requested judicially in order to determine the possible establishment of a guardianship or trusteeship of a subject who suffers from a compulsive buying disorder.
En la actualidad, la incapacitación civil se encuentra regulada en el derecho español en los artículos 199 y siguientes del Código Civil tras la reforma operada en dicho texto legal por la Ley 13/83 de 24 de octubre de 1983 la cual supuso un intento del legislador por potenciar al máximo las funciones de protección del derecho a las personas disminuidas y al mismo tiempo ofrecer a éstas las máximas garantías para poder defender y ejercitar sus derechos. Así, el artículo 199 del Código Civil dice que "nadie puede ser declarado incapaz sino por sentencia judicial en virtud de las causas establecidas por la Ley", complementando a dicho concepto legal el artículo 200 cuando establece "son causas de incapacitación las enfermedades y deficiencias persistentes de carácter físico o psíquico que impidan a la persona gobernarse por si misma". En el presente artículo se facilita un modelo de informe pericial psicológico solicitado judicialmente con el objeto de determinar el posible establecimiento de una tutela o curatela en un sujeto que padece un trastorno de compra compulsiva.
