Abstract

This work was done in order that the workers have knowledge of legislative rules we refuge in almost all aspects, and even when they have no occupational diseases are diseases suffered by workers for any reason, as long as no you are related to work activities, such as flu case, stress, allergic rhinitis caused disease or pregnancy and childbirth. One of the fundamental rights of workers who have suffered a non-occupational disease is entitled to be reinstated to their labor activities is a right guaranteed by the Constitution. We can also make mention of the rights and obligations of both the employee and the employer in different circumstances are such as to a worker who has a non-occupational disease is obliged to justify their absence from the workplace. We mention also what rights and guarantees that are embodied in the Constitution, Labour Code and Law on Labor Justice, which has the working woman who is in a state of pregnancy, or has suffered childbirth are caused disease. One of the benefits that today that is in vogue in Ecuador is the stability of working women in gestation, since the employer may not terminate the relationship of dependency by her pregnancy, if doing so is considered ineffective by a judgment of a court of Labor Jurisdiction of the place.
