Abstract
- Countries in transition are the best example of the impact of market changes on the economy, most of these countries possessed different ownership system based on which the legal and economic system. The so-called. dual ownership system where they were represented by private and public property, with a predominance of social ownership. After the transition from a socialist economy to a capitalist mode of production vision, market changes have caused major changes in the economy, hence the noticeable changes occurred within the legal system. The lack of regulation in the given field, resulting in the adoption of adoption or foreign legislation. While there were legal provisions that regulate a given area could not be fully applied to new changes. Competition law has a role to provide a legal scope of the market changes that lead to the creation of a monopoly, oligopoly and unfair competition. To this end there is a big number of legislation in both the continental and the Anglo-Saxon legal system. What what is the common feature of these regulations is that they occur under the influence of practice, in this case market practice. This paper will be presented the legal framework of international regulations in the area of competition law and their impact on the regulation of the transitional countries.<br />Zemlјe u tranziciji su najbolјi primjer uticaja tržišnih promjena na ekonomiju, većina ovih zemalјa je posjedovala različit svojinski sistem na kojem je bazirani pravni i ekonomski sistem. Tzv . dualni svojinski sitem gdje su bila zastuplјena privatna i društvena svojina, sa prevagom društvene svojine. Nakon prelaska sa socijalističkog načina privređivanja na kapitalistički vid proizvodnje, tržišne promjene su izazvalae velike promjene u ekonomiji, samim tim su osjetne promjene nastale i unutar pravnog sistema. Nepostojanje regulative iz date oblasti, je rezultiralo adopcijom odnosno usvajanjem stranih zakonskih rješenja. Iako su postojali zakonski propisi koji su regulisali datu oblast nisu mogli biti u potpunosti primjenjeni na novonastale promjene. Pravo konkurencije ima ulogu da zakonski obuhvati tržišne promjene koje dovode do stvaranja monopola, oligopola i nelojalne konkurencije. U tu svrhu su donijeti monogobrojni zakonski propisi kako u kontinentalnom tako i u anglosaksonskom pravnom sistemu. Ono što je zajednička osobina tih zakonskih propisa je da su nastali pod uticajem prakse, u ovom slučaju tržišne prakse. U ovom radu će biti prikazan zakonski okvir međunarodnih propisa iz oblasti prava konkurencije i njihov uticaj na regulativu zemalјa u tranziciji.
