Abstract
- Den danske regulering af udvidelse, ændring og nyetablering af husdyrbrug har over en årrække været præget af en ”knopskydning”, bl.a. som følge af implementeringen af EU´s IPPC- og VVM-direktiver i dansk lovgivning. Samlet set har de politiske initiativer i Danmark og EU-lovgivningen skabt et meget kompliceret regelsæt, med et komplekst samspil mellem generel og konkret regulering og mellem de forskellige virkemidler og kompetenceområder. Dette har bl.a. medført betydelige administrative byrder og langstrakt sagsbehandlingstid. Den 1. januar 2007 trådte en nye lov om miljøgodkendelse af husdyrbrug i kraft (husdyrloven). Baggrunden for loven skal findes i de problemer, der i stigende omfang har været knyttet til an-vendelse af planlovens VVM-bestemmelser for husdyrproduktioner og den sideløbende anven-delse af miljøbeskyttelseslovens bestemmelser, herunder miljøbeskyttelseslovens godkendelses-ordning. Formålet med loven var at reducere de administrative byrder og sikre en mere ensartet, hurtig og gennemskuelig sagsbehandling samt at skærpe kravene til renere teknologi. Formålet med specialet er, at forstå implementeringsprocessen og de vanskeligheder der har væ-ret forbundet med implementeringen af den nye husdyrlov for herigennem at kunne vurdere om den nye husdyrlov rent faktisk fører til mere simpel administration og en mere ensartet og gen-nemskuelig sagsbehandling. Vurderingen er begrænset af, at lovgivningen kun har virket i 12 måneder, og at der for tidspunktet for undersøgelsens afslutning endnu ikke var sager, der var endeligt færdigbehandlet. Der opstilles desuden en række refleksioner omkring implemente-ringsprocessen, som Regeringen og Skov- og Naturstyrelsen kan bruges fremadrettet i den fort-satte implementering af loven, samt næste gang der skal implementeres ny lovgivning på miljø-området. This is, among other things, a result of the implementa-tion of European IPPC- and VVM directions into the Danish legislation. All together, the political initiatives in Denmark and the legislations of EU have created a very complicated set of rules with a complex interaction between a general and a concrete regulation, and between the different means and competences. This has, among other things, resulted in tremendous administrative burdens and an extended casework time. On the 1st of January 2007, the new law about environmental approval of husbandry was established. The background for the law has to be found in the increasing problems which have been related to the use of the VVM-regulations for the production of domestic animals and parallel use of the regulations of the environmental protection law, which includes the approval arrangement of the environmental protection law. The purpose of the law was to reduce the administrative burdens and secure a more uniform, rapid and transparent casework. Furthermore the law tightened up the demands for use of more environmentally friendly technology. The objective of this thesis is to understand the process of implementation, and the difficulties that have been associated with the implementation of the new law about environmental approval of hus-bandry. Hereby it will be possible to evaluate whether the new law actually leads to a more simplified administration and a more uniform and transparent casework. The fact that the legislation only has been valid for 12 months, and that no cases during this period has been completed, limited the evalua-tion of the legislation in this thesis. The outcome of this section is a series of reflections regarding the process of execution, which the government and the Danish Forest and Nature Agency can use in the future work with implementation
