Abstract

The Supreme Court of Canada issued an important ruling on judicial independence in 1997 in The Judges' Reference, a collection of cases deriving from Alberta, Manitoba, and Prince Edward Island. The Court established three principles: that judicial independence derives from the Constitution Act of 1867, guarantees of judicial independence protect all courts, and the components of judicial financial security. The Court recommended a commission process for determining judicial salaries.
