Abstract
- A Kentucky court has declared that taxing physician revenues to pay for Medicaid is unconstitutional. However, a similar case in West Virginia is still pending. The Kentucky Medical Assn, in conjunction with six physicians and nine HMOs, argued that there was no legitimate basis for taxing physicians more than the general public for a program that benefits the entire community.
