Abstract

The purpose of this study is to bring to the debate the idea of human dignity and its relationship with fundamental and social human rights, in the context of policies and normative instruments related to the fundamental social right to basic sanitation. This includes an examination of its effectiveness within the reality of the municipality of São Borja. The study employs legal research methods such as bibliographic and jurisprudential analysis, relying on current legislation within the Brazilian and international legal framework. Additionally, it involves visits to neighborhoods with photographic records that illustrate the proposed theme. At the conclusion of the study, it specifically characterizes the need to recognize the inefficiency of access to basic sanitation services. This inefficiency may manifest in issues such as inadequate stormwater drainage networks, irregular sewer connections, and failures in waste collection and disposal in inappropriate locations. The study ultimately underscores that achieving effectiveness in these services should be a common goal of both legal and public regulatory bodies in the municipality, requiring harmony and cooperation from society.
