Abstract

This work analyzes militant democracy from a historical perspective, taking into account comparative law and its development in the Spanish constitutional system. For this, the different models of militant democracy applied in the European framework after World War II are identified, taking as a reference the processes of supranational integration. The fundamental thesis that in the past the defense of democracy was carried out against extremism and the totalitarian past, while in the present it is about preserving constitutional democracy for future generations in the face of new challenges such as terrorism, extreme speeches and populism. In this new phase of collective learning, the problems that arise the same as in the past: what is the link between means and ends and wich body should be the defender of democracy.
