UMA ANÁLISE DA PROTEÇÃO DOS DIREITOS HUMANOS PELA CONSTITUIÇÃO BRASILEIRA APÓS A EMENDA CONSTITUCIONAL Nº 45/2004: O CASO TPI - DOI: 10.12818/P.0304-2340.2012v61p127

O presente artigo apresenta uma breve análise da proteção dos Direitos Humanos dispensada pela Constituição Brasileira, com vistas a investigar seu alcance e promoção, sobretudo com as modificações resultantes da Emenda Constitucional nº. 45/2004. Promove-se, ainda, uma abordagem constitucional no sentido de investigar o conteúdo e significação da disposição referente ao Tribunal Penal Internacional. Após estas considerações chega-se então ao entendimento sobre a aplicação e eficácia jurídica das normas de Direitos Humanos garantidas pela Constituição da República Federativa do Brasil de 1988, para, por fim, definir o alcance do enunciado prescritivo trazido pelos parágrafos do seu artigo 5º. ABSTRACT This article presents a brief analysis of the human rights protection provided by the Brazilian Constitution, in order to investigate its scope and promotion, especially with the changes resulting from the Constitutional Amendment. 45/2004. Promotes itself also a constitutional approach to investigate the content and meaning of the provision concerning the International Criminal Court. After these considerations comes up then the understanding on the implementation and effectiveness of the legal standards of human rights guaranteed by the Constitution, to ultimately define the scope of the statement prescriptive brought by paragraphs of Article 5.
