Abstract

This paper analyzes the application of so-called procedural defensive jurisprudence that values exacerbated rationalization of the judiciary activities, preventing the processing of judicial review in the higher courts, and its consequences in consumeristas indemnity processes. It analyzes the pressure to which judges are subjected, especially because of the need to comply with productivity goals. The construction work suggests the misconception of these imposed judicial policies to decrease the procedural stock since that attack the problem on screen superficially and do not solve the basic question.
