ACESSO À JUSTIÇA: A MEDIAÇÃO E A ARBITRAGEM NA CONVENÇÃO EUROPEIA DOS DIREITOS HUMANOS: TOMO I

RESUMOObjetivos: o artigo busca contribuir para a discussão sobre se formas alternativas de resolução extrajudicial de conflitos, designadamente a arbitragem e a mediação pré-processual obrigatória poderão colocar em causa o direito de acesso à justiça previsto no artigo 6.º, da Convenção Europeia dos Direitos Humanos (CEDH).Metodologia: a pesquisa centra-se na análise e estudo da jurisprudência do Tribunal Europeu dos Direitos Humanos (TEDH), nas suas implicações com a problemática da mediação pré-processual obrigatória.Resultados: a arbitragem e a mediação pré-processual obrigatória, consagradas em alguns ordenamentos jurídicos, são compatíveis com o direito de acesso à justiça previsto no artigo 6.º, da CEDH.Contribuições: O artigo apresenta uma conceptualização importante numa altura em que se discute no âmbito da CEPEJ (Commission Européenne pour l’éfficacité de la justice) do Conselho da Europa, a possibilidade de uma Convenção sobre mediação apresentando esta um carácter pré-processual obrigatório.Palavras-chave: Direito de acesso à justiça; Estado de Direito; Mediação pré-processual obrigatória; Arbitragem. ABSTRACTObjective: This paper aims to discuss whether arbitration and mandatory mediation are compatible with the right of access to a court within the framework of article 6 of the European Convention on Human Rights.Methodology: The research focuses on the study of case law within the ambit of the European Court on Human Rights (ECHR).Results: The arbitration and mandatory mediation are compatible with the right of access to a court within the framework of article 6 of the European Convention on Human Rights.Contributions: This paper sets up an important theoretical framework at this particular moment in time when the possibility of a Convention about mandatory mediation is under discussion in the Council of Europe.Keywords:Right of access to a court; Rule of law; Mandatory mediation; Arbitration.
