17. VE 18. YÜZYIL KIBRIS ŞER‘İ MAHKEMELERİ VE ŞER‘İYYE SİCİLLERİNE BİR BAKIŞ

In17th and 18th centuries Cyprus was a typically Ottoman territory as managerialand judicial and depended on state center. By the time Reform term, in theOttoman State adopting the judicial judgement procedure, judicial courts havebeen institution that handled all manner of judicial disagreements. Thesecourts that appropriate the Islam law left behind registries containing veryvaluable information about judicial, economic, religious, military, managerialand social life in verious times of state. In view of importance of subject inthis article we will try elucidate Cyprus judicial courts and judicialregistries in the said period.
17ve 18. yüzyıllarda Kıbrıs, idarî ve adlî yapısı itibariyle tipik bir Osmanlıtoprağıdır ve devlet merkezine bağlıdır. Kuruluşundan itibaren şer‘î kazausulünü benimsemiş olan Osmanlı Devleti’nde şer‘î mahkemeler Tanzimat döneminekadar her türlü hukukî ihtilafın ele alındığı bir kurum olmuştur. İslâm hukukesaslarına istinat ettirilerek meydana getirilen bu mahkemeler geriye, devletinmuhtelif devirlerindeki hukukî, iktisadî, dinî, askerî, idarî ve içtimaî hayatıhakkında çok değerli bilgiler ihtiva eden siciller bırakmıştır. Konununöneminden hareketle bu makalede söz konusu döneme ait Kıbrıs şer‘î mahkemelerive şer‘iyye sicillerine ışık tutulmaya çalışılmıştır.
