Abstract
- On examine les premières traces du vol d’eau à l’époque républicaine ; on conduit ensuite l’étude dans quelques constitutions des Codes Théodosien (CTh XV, 2, 4 à 9) et Justinien (CJ 11, 43, 10, § 3) relatives au détournement abusif de l’eau des aqueducs publics, et on la poursuit jusqu’aux Variae de Cassiodore. On se penche sur les modalités de la répression de l’utilisation d’un bien public par des personnes privées. This paper first focuses on the earlier records about the theft of water, which can be traced back to the republican era. It then proceeds with the study of some constitutions taken from the Theodosian (CTh XV, 2, 4 to 9) and Justinian (CJ 11, 43, 10, § 3) Codes dealing with the excessive illegal tapping of water from public aqueducs, and it then goes as late as Cassiodorus’s Variae. Closer scrutiny is finally given to how such breaches of law – i.e. the use of the common wealth for the benefit of private individuals – were punished.
