Chapitre VIII - Leges Publilia et Maenia de patrum auctoritate – Positionen und Perspektiven

Die leges Publilia et Maenia, die erstmals die patrum auctoritas regelten und in die Entscheidungsprozesse im Senat integrierten, trugen ebenso wie das zeitnahe plebiscitum Ovinium de lectione senatus, das in der Phase der Etablierung der neuen patrizisch-plebeischen politischen Klasse die Rekrutierung des Senats durch die Censoren nach objektiven Kriterien fixierte, wesentlich zur Konsolidierung des Senats als stabiler, ständiger Institution bei. Das war wiederum eine wesentliche Voraussetzung für die Formalisierung der Willensbildung im Senat in Gestalt der senatus auctoritas. The leges Publilia et Maenia, which regulated the patrum auctoritas for the first time by integrating it in the decison-making processes in the senate, as well as the contemporary plebiscitum Ovinium de lectione senatus, which laid down objective rules of recruiting senators by the censors during the emergence of the new patrician-plebeian ruling class, substantially contributed to the consolidation of the senate as a stable, permanent institution. This in turn was an essential prerequisite of the formalization of decision-making processes in the senate in the shape of senatus auctoritas.
