79 numaralı Kütahya şer'iye sicilinin transkripsiyonu ve edisyon kritiği

II ÖZET Çalışma konusu olarak seçtiğimiz 79 Numara'lı Şer'iye Sicili'nde, tereke-miras, i'lam, hüccet belgelerinin transkripsiyonu ve değerlendirmesi yer almaktadır. Bu belgeler, miras, borç karan, olacağın isbatı, evlenme ve boşanma, alım satım, hibe ve temlik, vasi taini, vekil taini, konularını içermektedir. 79 Numaralı Kütahya Şer'iye Sicili'nde belgelere yansımış hadiselere bakarak halkm sosyal yapısını, terekelere bakarak ekonomik yapısını, merkezden gönderilen kararnamelere bakarak; merkezi idare ile mahalli idari arasındaki ilişkilerin durumunu öğrenmekteyiz. Halk kullanmış olduğu lehçenin muhafazası hususunda dikkat etmiştir. Birçok yer ve eşya isimlerinin aynen kullanılması bunun açık bir delilidir. Bu hususlar milleti millet yapan en önemli özelliklerden biridir. Halk kendi örf, adet, gelenek ve göreneklerine bağlı olup bunun neticesinde de birçok köy, mahalle, nahiye ve kaza ismi ve günlük konuşmalardaki bazı eşya isimleri ve deyimler olduğu gibi muhafaza edilmiştir. Osmanlı devleti kurulduğunda tayin edilen iki memurdan birisinin kadı olması ve Osmanlı hakimiyeti boyunca adalet müessesesinin mükemmel denebilecek bir şekilde işlemesi, Osmanlı Devletinin yıkılmasını 3 asır geciktirmiştir. Şer'iye Mahkemesinde verilen birçok hükmün altında `Şuhudu'1-hal` denilen ve o kaza bölgesinin ileri gelenleri arasından seçilen ve sayıları beş altı veya daha fazla olup aralarında önemli hukukçularında yeraldığı şahitlerin olması kayda değer önemli bir husustur. Kanunlar birden fazla evliliğe müsaade etmesine rağmen bu dönemde mahkemeye intikaleden davalardan sadece birinde iki evli birinin olması halkın örfünün gereği olarak daha çok tek evliliği tercih ettiğini ve birden fazla evli olanların ise mahkemeye intikal edeceke kadar çok problemlerin olmadığını göstermektir. Belgelerde had cezasını gerektirecek hırsızlık ve kati davalarının olmaması o dönemde halkın bu konulardaki titizliğini göstermektedir. Ill ABSTRACT The authors studied, chosen as subject the number of seventynine the register of the religious law, takes part a transcription and an evaluation of heritage, making known, evidence and documents of pious foundation. At the seventynine the register of the religious law of Kütahya, when we looked about to events which is reflected to the documents, we learn social structure of people, when we looked about to heritage, we learn economic structure, when we looked about to written decree which is sent from center, we learn condition of relation between center management and local management. People had been careful to dialect for keep it. It is a clear event that a lot of place and the rename of objects had been used exactly the same. This matters, which is one of the important peculiarity make a nation to nations. All of the dependent on own usage's, customs and traditions. For that reason, a lot of the name of village, district, township and country and the names of some object and expressions are kept the same. At the foundation of the Ottoman state, because of appoint two officials and one of the both is magistrate and during the rule of Ottoman since the justice foundation was put in operation excellently, The college of the Ottoman state was delayed three years. At the count of the religious law, three are a lot of important lawyers, which is named `straight witness`. They are chosen from this country and notables.
