Yerli ve yabancı profesyonel futbolcu alacaklarından doğan uyuşmazlıkların tahkim yolu ile çözümü

Bu çalışmayı yapmaktaki temel amacımız, yerli ve yabancı profesyonel futbolcuların alacak uyuşmazlıklarının tahkim yolu ile çözümü usulünü ortaya koymaktır. Çalışmamızda benimsediğimiz temel görüş, yerli futbolcuların alacak uyuşmazlıkları hakkında münhasır yetkili Türkiye Futbol Federasyonu Uyuşmazlık Çözüm Kurulu ile Tahkim Kurulu'nun yeterince bağımsız ve tarafsız tahkim kurulları olmadığı ve bu sebeple yerli futbolcuların hak arama özgürlüğünün kısıtlandığı yönündedir.Çalışmamızın başında genel olarak spor hukukunda tahkim müessesesini incelemeyi uygun bulduk. Bu bağlamda, spor hukukunda tahkimin tercih edilme sebepleri, Türk spor hukukundaki tahkim düzenlemeleri, milletlerarası spor yapılanması ve milletlerarası spor hukukundaki tahkim düzenlemelerini inceledik.Çalışmamızın ikinci bölümünde ise, yerli yabancı profesyonel futbolcu kavramından ne anlaşılması gerektiğine, profesyonel futbolcu sözleşmesine, yerli profesyonel futbolcuların alacak ihtilaflarında görevli ve yetkili tahkim kurullarına, bu kurulların yargılama usullerine değindik.Çalışmamızın son bölümünü ise, yabancı profesyonel futbolcuların alacak ihtilaflarının tabi olduğu usule ayırdık. Bu kapsamda öncelikle FIFA'yı ve bu kararları temyizen inceleyen CAS' ın yargılama yetkisini ayrıca CAS kararlarının iptali ve tenfizini inceledik. The purpose of this study is to examine the method arbitration while determining the disputes arising out of credits of local and foreign footballers. The main idea in the study is that the Turkey Football Federation Dispute Resolution Committee and the Arbitration Committee are merely established and exclusively competence for national footballers? credit disputes, therefore cannot be considered as independent and impartial arbitration committees. Whereupon this constraints the right of local footballers.In the first chapter of this study we will be examining the role of Arbitration in Sports Law. Furthermore the reasons why the arbitration is chosen while resolving the disputes in Sports Law, the regulations regarding arbitration procedure in Turkish Sports Law, establishment of sports in international area and the regulations of arbitration in International Sports Law are also subjects of this chapter.In chapter two, we will discuss the meaning of local and foreign footballers and the contracts of professional footballers. In addition to that the authorised arbitration committees for the disputes arising out of local footballers? credits, the applicable proceedings for the said committees will be analysed.In the final chapter, we will be examining the authorised arbitration committees for the disputes arising out of foreign footballers? credits. In this regard, primarily FIFA and as a court of appeal Court of Arbitration for Sports? jurisdiction also annulment and recognition of the arbitration awards will be examined. 94
