Genel kredi sözleşmelerinde kefalet ve kefilin hukuki sorumluluğu

Çalışmamızın konusu genel kredi sözleşmelerinde kefilin sorumluluğu ve kefaletin sona ermesi hakkındadır. Çalışmamız iki bölümden oluşmaktadır. İlk bölümde genel olarak ve kefalet türlerine göre genel kredi sözleşmelerine kefilin sorumluluğunun kapsamı, kefilin sorumluluğunun kapsamına nelerin girebileceği ve kefilin yapabileceği savunmaları incelenmiştir.İkinci bölümde ise genel kredi sözleşmelerinde kefilin sorumluluğunun asıl borca bağlı olarak veya kefalet sözleşmesinden kaynaklanan sebeplerle sona ermesi, süreli ve süresiz kefaletin sona ermesi, kefilin kefalet sözleşmesinden dönmesi konuları ele alınmıştır. Subject of the our thesis about expiring Responsibility of Guarantee in General Loan Agreements and Termination of Guarantee Contract. Our thesis is composed of two part.In the first part, we have examined the extent to which the responsibility of assuring general loan contracts in general and types of sureties can be entered into and covered by the scope of the responsibility of the guarantor.In the second part, we examined subjects that are termination of guarantors responsibility of principal debt according to general loan agreements or reasons from guarantors agreement, termination of timed or untimed surety, guarantors annuling the agreement of surety.Keywords:, Comprehensibility of Responsibility in General Loan Agreements, Responsibility of the Surety 158
