Mevzuatta ve yargısal içtihatta şehircilik ilkeleri

Bu tezde, mevzuatta ve yargısal içtihatta ölçüt olarak kullanılan şehircilik ilkeleri üzerinde durulacaktır.Öncelikle, şehirciliğin tarihi gelişimi incelenmiş ve 1921, 1924, 1961 ve 1982 Anayasaları açısından kısaca ele alınmıştır. Ardından, bu konudaki Boğaziçi Kanunu, Kıyı Kanunu, Milli Parklar Kanunu, Kültür ve Tabiat Varlıklarını Koruma Kanunu, Çevre Kanunu ve İmar Kanunu ile bu Kanunlarla ilgili Yönetmeliklerin hükümleri ile bu konularda verilmiş Danıştay içtihatları ve AİHM kararları değerlendirilmiştir. In this thesis, principles of urbanism which are used as a criterion in legislation and case law are being focused.First of all, history of urbanism development is examined and principles of urbanism are discussed briefly in terms of 1921, 1924, 1961 and 1982 Constitutions. Right after that, The Bosphorus Act, The Coast Act, The National Parks Act, The Protection of Cultural and Natural Resources Act, The Environment Act and The Zoning Act, The Regulations related to these Acts and Decisions of The Council of State and ECHR related to these issues are evaluated. 90
