Abordagem jurídico-econômica da responsabilidade civil : para além da indenização

A presente dissertação examina as funções da responsabilidade civil no Brasil, ponderando sobre sua efetiva utilidade prática e sobre o alcance dos objetivos a que se propõe. Analisa as principais contribuições que a corrente da Análise Econômica do Direito pode apresentar à disciplina, encontrando em medidas de general e de specific deterrence, já existentes ou ao menos compatíveis com nosso sistema jurídico, alternativas viáveis à redução dos custos sociais. O tema é analisado, inicialmente, a partir da doutrina jurídica tradicional, ponderando sobre os objetivos traçados para a responsabilidade civil no Brasil, objetivos que muitas vezes não são materializados na prática jurisprudencial. Em seguida, a abordagem é feita sob o viés da Análise Econômica do Direito, escancarando as diferenças de pensamento entre as correntes de estudo, assim como as contribuições que esta visão pode dar àquela, sem que seja estritamente necessária qualquer alteração legislação nacional. The present Master Thesis analyzes the functions of Civil Responsibility in Brazil, considering its efective practical utility and the achievement of its main goals. This thesis evaluates the main contributions that Law and Economics can bring to Civil Responsibility, finding viable alternatives to reduce social costs through measures of general and specif deterrence that are compatible with Brazilian’s Legal System. The object of this Master Thesis is developed departing from the exam of traditional juridical doctrine’s set of goals for Civil Responsibility in Brazil, which many times are not accomplished in jurisprudence. Sequently, the approach is made under the light of Law and Economics, presenting the core differences beetween both study lines, as well as the contributions that Law and Economics is able to bring to the traditional juridical doctrine without the necessity of modifying the current legislation.
