Pelo direito de crescer, saber e ser : as interseccionalidades de gênero e idade na proteção das meninas no sistema interamericano de direitos humanos

Defesa : Curitiba, 01/06/2022 Inclui referências Resumo: A dissertação busca trazer reflexões acerca da proteção das meninas no Sistema Interamericano de Direitos Humanos. Por meio de uma lente interpretativa que soma as premissas do feminismo interseccional e do constitucionalismo multinível, ou seja, de formas em que é possível desenvolver o diálogo de modo a ampliar a proteção de direitos humanos, tem como objetivo apresentar uma ótica adequada frente à violação de direitos humanos de meninas na América Latina, mais especialmente no Brasil. Assim, por meio de revisão de bibliografia e das diretrizes normativas e interpretativas presentes no Sistema Interamericano de Direitos Humanos, condicionou uma base teórica para análise crítica dos dados obtidos posteriormente. Do mesmo modo, foi realizada uma pesquisa quali-quantitativa em relação aos casos contenciosos analisados pela Corte IDH, que contenham principalmente violação do art. 19 (direito à infância) e discriminação de gênero, podendo ou não conter violações à Convenção Interamericana para Prevenir, Punir e Erradicar a Violência contra a Mulher - a Convenção Belém do Pará, para realizar um mapeamento dessas intersecções no SIDH, bem como se ocorre alguma mudança específica na reparação. Após a coleta de dados, foi realizada a interpretação subjetiva dos dados obtidos, realizando análise comparativa e crítica, de forma a identificar as principais problemáticas encontradas, chegando à violação de uma tríade de direitos: de ser, de saber e de crescer. Por fim, ventila-se possíveis pontos focais de debate para a resolução destes obstáculos de efetivação de direitos humanos quando há a intersecção de gênero e idade. Busca-se demonstrar, portanto, por meio de um feminismo que permita dissensos e cresça com as diferenças, e com uma visão de constitucionalismo que abarque um bloco de constitucionalidade extenso e plural, uma semente de esperança e luta em estudos desta seara. Abstract: This dissertation seeks to reflect on the protection of girls in the Inter-American Human Rights System. Through an interpretative lens that combines the premises of intersectional feminism and multilevel constitutionalism, that is, ways in which it is possible to develop dialogue to expand the protection of human rights, it aims to present an adequate perspective on the violation of the human rights of girls in Latin America, especially in Brazil. Thus, by means of a literature review and the normative and interpretative guidelines present in the Inter-American System of Human Rights, it has conditioned a theoretical basis for a critical analysis of the data obtained later. Likewise, a quali-quantitative research was carried out in relation to the contentious cases analyzed by the Inter-American Court of Human Rights, which mainly contain violations of art. 19 (right to childhood) and gender discrimination, and may or may not contain violations of the Inter-American Convention on the Prevention, Punishment and Eradication of Violence against Women - the Belém do Pará Convention, in order to map these intersections in the IAHR, as well as if any specific changes in reparations occur. After data collection, the subjective interpretation of the data obtained was carried out, performing comparative and critical analysis, to identify the main problems found in Latin America and Brazil, arriving at the violation of a triad of rights: to be, to know and to grow. Finally, possible focal points of debate for the resolution of these obstacles to the realization of human rights when there is the intersection of gender and age are ventilated. We seek to demonstrate, therefore, through a feminism that allows dissent and grows with the differences, and with a vision of constitutionalism that embraces an extensive and plural constitutionality block, a seed of hope and struggle in studies of this field.
