Registration of Space Objects Amenably International Space Law: Procedure and Legal Consequences

Abstract

The article analyzes legal consequences caused by the registration of space objects (henceforth, SO) for the state of record and for other subjects of international law. The analysis of relevant norms of international space law made it possible to draw the following conclusions: duties of performance and compliance with procedures for SO registration rest on the state of record (this can create a certain financial and organizational burden on the last mentioned); the state of record can exercise jurisdiction and control over the space object and its personnel (including the astronauts’ rescue and redemption); the ownership of space objects launched into outer space belongs to the state of registration. In contrast to the aforementioned legal consequences related to the state of registration, legal consequences regarding responsibility (property liability for damage caused by a space object, and other types of liability for the launch and use of space objects) are related precisely with the launching state (or states) in accordance with international space law. The article highlights that in cases when two or more states participate in the launch of a space object, then it is appropriate to reach agreements on specific aspects of legal consequences of registering a space object, and responsibilities in connection with activities related to this SO launch and use in order to protect their rights and interests. In conclusions, it is recommended to consolidate such agreements by concluding a written international treaty. The research results are based on the application of logical, analytical and synthetical methods.
