The Financial Legal Regulation of the Fund Deposit Guarantee in Ukraine in the Terms of the Function of Withdrawal of the Insolvent Banks from the Market

Стаття присвячена дослідженню питання виконання Фондом гарантування вкладів фізичних осіб в Україні функції виведення неплатоспроможних банків з ринку. Автором проводився аналіз змін нормативно-правового регулювання окреслених вище питань, пов’язаних насамперед із євроінтеграційними процесами в Україні. Оскільки забезпечення ефективного виконання Фондом гарантування вкладів фізичних осіб в Україні є одним із аспектів забезпечення фінансової стабільності держави, потрібно виокремити проблемні питання, пов’язані із гармонізацією фінансового законодавства України та Європейського Союзу, та на підставі аналізу внести відповідні зміни до нормативно-правових актів України, що регулюють діяльність філій іноземних банків на території України. Стабільність фінансової системи в країні можлива лише за наявності у держави можливості застосування вагомих важелів впливу на розвиток відносин, які виникають саме в цій системі, зокрема правового регулювання діяльності її елементів: створення нормативної бази, на основі якої будуть діяти суб’єкти фінансового ринку, а також створення основних принципів, на підставі яких буде провадитись нагляд за діяльністю таких суб’єктів. Слід зауважити на тому, що беззаперечним є факт існування в середині такої системи більш дрібних, проте не менш важливих підсистем чи систем, таких, наприклад, як система гарантування вкладів фізичних осіб. Залежно від переліку цілей, які поставлені перед системою гарантування вкладів, побудована і внутрішня структура такої системи, що впливає на принципи, форми діяльності її суб’єктів, об’єм повноважень уповноважених суб’єктів системи, а також на взаємодію елементів системи. Звідси вихідним є те, що ефективність функціонування системи впливає на її стабільність. Проте динамічність та безперервність розвитку системи в свою чергу впливає на зміни нормативно-правового регулювання функціонування елементів такої системи. The article investigates the issues of the implementation of the Fund Deposit Guarantee in Ukraine features on the withdrawal of insolvent banks from the market. The author analyzes the changes of legal regulation outlined above the issues related primarily to the European integration processes in Ukraine. As ensure the effective implementation of the Fund Deposit Guarantee in Ukraine is the one of the aspects of the financial stability of the state, should highlight the issues related to the harmonization of the financial legislation of Ukraine and the European Union, and on the analysis to amend the regulations Ukraine regulating activity of branches of foreign banks in Ukraine. The stability of the financial system in the country is possible only if the state has the possibility of the significant leverage for the development of relations arising in that system, including legal regulation of its elements: the creation of the regulatory framework on which will operate the financial market, and creating the basic principles on which will be carried out the supervision of the financial entities. It should be noted that the existence is the undisputed in the middle of the system smaller, but no less the important subsystems or systems, such as the system of guaranteeing deposits of the individuals. Depending on the goals that are set before the deposit guarantee system, built and internal structure of the system, affecting the principles, forms of its subjects, the volume powers the authorized business system and the interaction of the system. This source is that the effectiveness of the system affects its stability. However the dynamism and the continuity of the system in turn affect the changes of the legal regulation of the elements of the system.
