THE LEGAL ANALYSIS OF RELATIONSHIPS BETWEEN THE POLICE AND THE LOCAL WARRENTS

Abstract

V Sloveniji zagotavljata varnost v lokalnih skupnostih tako policija kot občinska redarstva. V primerjavi s policijo, ki je pristojna za opravljanje nalog na območju celotne Slovenije, pa so občinska redarstva omejena na območje občine ustanoviteljice. V prvem delu diplomske naloge sem analizirala kakšna pooblastila imajo policisti po Zakonu o nalogah in pooblastilih policije ter občinski redarji po Zakonu o občinskem redarstvu. Vključila sem še primerjavo njunih nalog po Zakonu o javnem redu in miru, Zakonu o pravilih cestnega prometa in po Zakonu o prekrških. V tem delu sem tudi analizirala primer Mestne občine Ptuj, ki je najstarejše mesto v Sloveniji in zato turistično privlačna destinacija, prepletena z veliko rekreativnimi potmi in je ureditev področja varnosti pomembna. V zadnjem delu sem primerjala pravno ureditev Slovenije z ureditvijo drugih držav članic Evropske Unije, natančneje s Hrvaško in Italijo. Kljub temu da so članice Evropske Unije in so pravni redi držav članic v skladu z mednarodnim pravom, pa se njihovi notranji pravni redi med seboj razlikujejo. In Slovenia there are the police as well as the local warrents that ensure safety in the local communities. Comparing with the police, which operates at the state level, are local warrents, which was set up in every municipality and are therefore part of local communities. In the first part of the diploma paper, I presented authorisations and tasks of the police according to ‘The Act on the Tasks and Powers of the Police' and authorisations and tasks of the local warrents according to 'Act on Local Police'. I have also included 'The Act on the protection of public order and peace', 'The act on the rules of the road traffic' and 'The Offences Act' to compare tasks of the police and the local warrents according to this acts. In this part I have also analysed the case of the Municipality Ptuj, the oldest town in Slovenia and as such an attractive tourist destination intertwined with many recreational trails in which the safety regulation is important. In the last part I researched politics of some other European Union members. As an example, I reviewed the legal politics in Croatia and Italy. Although all these countries are members of the European Union and follow international politics their politics and arrangements differ from one country to another.
