Das revistas pessoais de prevenção e segurança realizadas pelo assistente de recintos de espetáculos na atividade de segurança privada

O presente estudo tem como objeto o regime das revistas pessoais de prevenção e segurança no âmbito da especialidade da profissão regulada do segurança privado – o assistente de recintos de espetáculos. Discorre-se sobre uma temática com marcos importantes introduzidos através da última revisão legislativa, percorrendo-se as premissas introduzidas pela Lei n.º 46/2019, de 08 de julho, e o alcance introduzido com as revistas realizadas pela especialidade em estudo. O cuidado foi direcionado para a identificação e análise do regime das revistas em locais de acesso vedado ou condicionado ao público, cujo contexto assente nos espetáculos e divertimentos públicos, isolando-o das autorizações passíveis de serem concedidas às demais especialidades da profissão de segurança privado. Identificou-se um conjunto de aspetos relevantes que são omissos ao regime atual, concluindo-se que uma próxima revisão legislativa deverá observar uma maior agudeza às competências da especialidade em estudo, que se considera serem da esfera da segurança privada e complementares à segurança pública. The object of this study is the regime of personal searches for prevention and safety within the scope of the specialty of the regulated profession of private security guard - the assistant in entertainment venues. A theme with important milestones introduced through the last legislative revision is discussed, going through the premises introduced by Law No. 46/2019, of July 8, and the scope introduced with the searches performed by the specialty under study. Care was directed to the identification and analysis of the regime of searches in places of access prohibited or conditioned to the public, whose context is based on public shows and entertainment, isolating it from the authorizations that may be granted to the other specialties of the private security profession. A number of relevant aspects that are missing in the current regime were identified, concluding that the next legislative revision should observe a greater sharpness to the competences of the specialty under study, which are considered to be of the private security sphere and complementary to public security.
