As repercussões da gestação de substituição no direito do trabalho: um caso de discriminação?

O artigo versa sobre as repercussões da gestação de substituição no direito do trabalho, em particular sobre os direitos laborais de parentalidade. Esta temática ganhou relevância no ordenamento jurídico português após a promulgação da Lei n.º 25/2016, de 22 de agosto, que veio permitir o recurso à gestação de substituição a título gratuito e excecional. Assim, urge perceber qual o impacto e as consequências jurídicas da gestação de substituição no mundo laboral, tendo por base a regulamentação legal consagrada no nosso ordenamento jurídico, coadjuvados pela experiência legislativa e jurisprudencial da União Europeia nesta matéria.
The article deals with the repercussions of the surrogacy in the labor law, in particular on labor rights of parenthood. This theme has gained relevance in the Portuguese legal system after the promulgation of Law no. 25/2016 of August 22, which allowed the recourse to surrogacy, gratuitous and exceptional title. Therefore, it’s urgent to understand the impact and legal consequences of the surrogacy in the world of work, based on the legal regulation enshrined in our legal system, supported by the legislative and jurisprudential experience of the European Union in this matter.
