EL PROCESO PENAL ESPAÑOL Y LA PRUEBA ILÍCITA

This paper studies the existence of a legal regime regarding illegal evidence in Spanish law. With that purpose, it refers to its legislative history, to its legal foundations and the particulars of its regulation. Also, the paper explains the development of Spanish Constitutional Court´s doctrine on the subject of the illegally obtained evidence, from its beginnings in the early eighties to our days.
En el presente estudio se analiza si cabe hablar de un régimen legal de la prueba ilícita en el Derecho español, con exposición de sus antecedentes legislativos, de su fundamento legal y de las particularidades de su regulación. Asimismo, se expone cuál ha sido la evolución de la doctrina del Tribunal Constitucional de España en materia de eficacia de la prueba ilícitamente obtenida, desde su creación, en los primeros años ochenta, hasta el presente.
