Neutral Territory: Juxtaposed Sovereignties and Duels of Honor at the Margins of The South American National States from the Middle of the 19th Century to the First Decades of the 20th Century

RESUMO: O presente artigo pretende discutir as relações entre as práticas de duelos de honra com a legislação penal e as fronteiras nacionais. Está organizado em três partes: (a) o Estado nacional e a fronteira, na qual se busca abordar como a historiografia tem lidado com a atuação do Estado nos espaços de fronteira e os aspectos das soberanias justapostas que colocam margens de ação para os indivíduos; (b) as discrepâncias das legislações sobre duelo de honra na Argentina, Brasil e Uruguai e suas soluções jurídicas díspares para o fenômeno; e (c) a busca dos duelistas por territórios neutros, analisando-se casos de duelos em espaços de fronteira. Por fim, pretende-se uma melhor compreensão da honra, e de seus sistemas de defesa, na transição de sociedades aristocráticas para as sociedades burguesas com a necessária reconfiguração de seus significados e uma reestruturação de suas definições sociais. ABSTRACT This article discusses the relations between the practices of honor duels with criminal law and national frontiers. The article is organized in three parts: (a) the national State and the frontier, approaching how historiography has dealt with the State action in its borders and the aspects of the juxtaposed sovereignties that defines margins of action for the individuals; (b) the discrepancies of the laws regarding honor duels in Argentina, Brazil and Uruguay, and their different legal solutions to the same phenomenon; and (c) the search of the duelists for neutral territories, where cases of duels in border spaces are analyzed. Finally, a better understanding of honor and its defense systems is sought in the transition from aristocratic societies to bourgeois societies with the necessary reconfiguration of its meanings and restructuration of its social definitions.
