ОТРИЦАНИЕ ИСКА В КАЧЕСТВЕ СРЕДСТВА ЗАЩИТЫ ОТВЕТЧИКА В СУДЕ

Согласно данным статистики уровень подаваемых исковых заявлений растет с каждым годом, потому очень важно разбираться в способах защиты своих прав. В данной статье автор пытается выяснить, стоит ли считать отрицание иска самостоятельным средством защиты для ответчика, так как касательно данного вопроса до сих пор ведутся споры. В статье также указывается, что принято понимать под отрицанием иска и в каких случаях данный прием обычно используется. Далее приводятся точки зрения цивилистов касательно места отрицания иска среди средств защиты и их оценка автором. В завершение, отрицание иска анализируется исходя из значения слова «отрицание». Из проведенного исследования автор приходит к выводу, что простое отрицание иска не стоит рассматривать в качестве самостоятельного средства защиты, оно представляет собой составную часть возражения, наряду с доводами, рассуждениями и доказательствами.
According to statistics, the level of claims filed is growing every year, therefore it is very important to understand how to protect your rights. In this article, the author tries to find out whether the denial of the claim should be considered an independent remedy for the defendant, since there are still disputes regarding this issue. The article also indicates what is usually understood as a denial of a claim and in what cases this technique is usually used. The following are the points of view of civil law experts regarding the place of denial of a claim among the remedies and their assessment by the author. Finally, the denial of the claim is analyzed based on the meaning of the word "denial". From the study, the author comes to the conclusion that a simple denial of a claim should not be considered as an independent remedy, it is an integral part of the objection, along with arguments, reasoning and evidence.
