ПРАВОВЫЕ АСПЕКТЫ «КУЛЬТУРНОЙ РЕВОЛЮЦИИ» В КИТАЕ

В статье осуществлен историко-правовой анализ такого исторического события, как «культурная революция». Изучены причины появления данной политической кампании, регламентирующая её ход правовая база. Особое внимание уделяется хунвейбинам - одной из движущих сил данной кампании и итогам их деятельности. Рассматривается взаимодействие государства и хунвейбинов. Делается вывод, что государство в данный период не просто не могло гарантировать защиты прав граждан, но и систематически поощряло их нарушение сторонними лицами. Уникальность рассматриваемого явления заключается в том, что высшая власть Китая, управлявшая к рассматриваемому периоду страной уже не первый год, сохраняя государственность и правовую систему, собственноручно развязало классовый конфликт. В итоге, внеправовое и внесудебное использование масс в целях борьбы с политическими оппонентами привело к резкому росту преступности и многочисленным жертвам. При этом многие сферы жизни общества на долгие годы были заморожены.
The article provides a historical and legal analysis of such a historical event as the "cultural revolution". The reasons for the emergence of this political campaign, the legal framework regulating its course are studied. Particular attention is paid to the Red Guards - one of the driving forces of this campaign and the results of their activities. The interaction between the state and the Red Guards is considered. It is concluded that the state during this period not only could not guarantee the protection of the rights of citizens, but also systematically encouraged their violation by third parties. The uniqueness of the phenomenon under consideration lies in the fact that the supreme power of China, which by the period under review had been ruling the country for more than a year, while maintaining statehood and the legal system, unleashed a class conflict with its own hands. As a result, the extralegal and extrajudicial use of the masses in order to fight political opponents has led to a sharp increase in crime and numerous victims. At the same time, many spheres of social life were frozen for many years.
