There is Nothing 'Humanitarian' About International Humanitarian Law

Abstract

The laws of war have in the past decades been commonly referred to as international humanitarian law. Yet it is confusing and misleading to call this discipline “humanitarian law”. This short paper questions whether IHL is really humanitarian – after all, does IHL do more to restrain or to promote war? Is its offer of protection realistic? Or, to put it simply, is it part of the solution to war or rather part of the problem?
