Çalışma konumuz olan yapı alacaklılarının kanuni ipotek hakkı da tam olarak bu sektörü ilgilendirmektedir. Zira özellikle ekonomik kriz dönemlerinde taşınmaza malzeme vererek veya vermeden emek sarf etmelerine ve taşınmazda değer artışına sebep olmalarına rağmen, alacaklarını elde etmekte güçlük çeken birçok yapı alacaklısının mevcut olduğu bilinmektedir. İşte bu şekilde malzeme vererek veya vermeden emek sarf eden ve taşınmazda bir değer artışı meydana getiren yapı alacaklılarını kanunumuz arsa sahibine karşı bir ipotek hakkı ile korumak ihtiyacını duymuştur. Buna “yapı alacaklılarının kanuni ipotek hakkı” adı verilmektedir. Kanunun koyucunun mevcut düzenlemesine rağmen, uygulamada yapı alacaklılarının kanuni ipotek hakkından yeterince faydalanılmadığı görülmektedir. Dahası ne doktrinde ne de Yargısal İçtihatlarda bu konu üzerinde yeterince durulmamıştır. Tüm bu nedenler bizi “yapı alacaklılarının kanuni ipotek hakkı” konusunu incelemeye sevketmiştir. 2001 yılında yürürlüğe giren Türk Medeni Kanunu çerçevesinde derinlemesine bir inceleme yaparak, uygulamaya yönelik bir çalışma hazırlamayı amaçlamaktayız. Key words : Construction creditors’ lien, LienABSTRACTLIEN OF THE CONTRUCTION CREDITORThe fact that the construction market is a developing market in Turkey and therefore has a major contribution to the economy is fairly accepted. The construction creditor’s lien which constitutes the main subject of this thesis is directly related to the construction market. Thus there are many construction creditors who contribute to the buildings by either or not providing equipment or labor and improving the value of the building, then have difficulties in collecting their claims. The construction creditors who have contributed to the building by providing equipment or supplying labor are protected by the law under an encumbrance right which is called “the construction creditors’ lien”.Despite the existing regulation, in practice the building creditors’ can not benefit from the encumbrance rights satisfactorily. Moreover, neither the doctrine nor the precedents have satisfactorily referred to the construction creditors’ lien. Therefore the foregoing has forced us to examine “the construction creditors’ lien”. This thesis aims to make an in depth examination in line with the Turkish Civil Code which has entered into force in 2001 and provide a guide to the implementation of such encumbrance right.
