El Tribunal Constitucional y la autonomía de Catalunya: crónica de un disparate

El artículo, como su título indica, es una crónica de cómo, en el proceso de control de constitucionalidad de la Reforma del Estatuto de Autonomía de Catalunya por parte del Tribunal Constitucional, se produjo una desviación de lo previsto por el constituyente, destruyéndose con dicha desviación los dos pilares en los que descansa la Constitución Territorial de 1978: el pacto entre el Parlament y las Cortes Generales y el referéndum de ratificación de dicho pacto. La STC 31/2010 destruyó ambos pilares. Con dicha Sentencia Catalunya ha quedado fuera, no formalmente pero sí materialmente, de la Constitución. The article, as its title indicates, is a chronicle of how, in the process of constitutional control of the Reform of the Statute of Autonomy of Catalonia by the Constitutional Court, there was a deviation from that provided by the constituent, destroying with this deviation the two pillars on which the Territorial Constítution of 1978 rests: the pact between the Parliament and the Cortes Generales and the referendum of ratification of this pact. JTS 31/2010 destroyed both pillars. With this ruling, Catalonia has not formally but materially been excluded from the Constitution.
