Condición jurídica de la mujer en Derecho Romano

El presente trabajo realiza un análisis jurídico-histórico de la posición jurídica de la mujer en Derecho Romano. En primer lugar conoceremos la situación de la mujer teniendo en cuenta su incapacidad para el ejercicio de los derechos públicos y su especial consideración en la esfera religiosa. En cuanto a la mujer como sujeto de derecho en el ámbito de lo privado atenderemos fundamentalmente a la diferencia entre la capacidad de obrar y la capacidad jurídica. Es necesario destacar su papel como integrante en la familia romana, las diversas situaciones en que podría encontrarse como mujer casada o hija de familia. La distinción entre sui iuris y alieni iuris, pues era base de su incapacidad para realizar determinados actos jurídicos, con especial mención a la tutela y la sucesión testamentaria. The present work performs a juridical-historical analysis of the legal position of women in Roman Law. First of all, we will know the situation of women taking into account their inability to exercise public rights and their special consideration in the religious sphere. With regard to women as subjects of law in the private sphere, we will focus primarily on the difference between the capacity to act and legal capacity. It is necessary to highlight her role as a member of the Roman family, the various situations in which she could find herself as a married woman or daughter of a family. The distinction between sui iuris and alieni iuris, as it was the basis of her inability to perform certain legal acts, with special mention to guardianship and testamentary succession.
