Abstract: The article discusses how lawyers may interview witnesses without causing them to breach any obligations of confidentiality in Australia. Topics mentioned include the issuing of subpoenas under the Supreme Court Rules of Victoria, the obligation of parties to cooperate under the Civil Procedure Act, and cases in which a witness is employed by another party.
