Independence of Commercial Dispute Trials.

At present, commercial disputes account for a large portion of cases the court has to handle in China. However, the court is still resorting to traditional civil law concepts or administrative law concepts when solving these commercial disputes. This has created a lot of troubles when deciding such cases. By analyzing several sample cases, this paper aims to demonstrate the importance and the urgency to realize the independence of commercial dispute trials through throwing light on the following issues: the special characteristics of the commercial law concepts; the special characteristics of the means of remedies in commercial cases; the special characteristics of the commercial laws and regulations; and the internationalization of commercial law.
