Abstract

The article discusses an assertion which states that permanent injunction should be grated on providing proof of patent validity, copyright ownership or trademark infringement. It discusses the U.S. Supreme Court case eBay v. Merc-Exchange LLC, wherein it was held that injunction should not be automatically issued based on a finding of patent infringement. It presents information on Canadian laws which are similar to the U.S. laws regarding intellectual property infringement.
