Abstract
- The article discusses the legal defense of consent to harmful assaults under New Zealand law as of September 2012, focusing on the Great Britain House of Lords' decision in the 1994 Brown case which deals with the point at which the consent defense is no longer available in relation to criminal liability. Several legal cases involving the New Zealand Court of Appeal are examined, including the 2006 manslaughter case of Lee.
