Abstract

The article discusses the tort of battery and the Great Britain Queen's Bench case Wilkinson v. Downton as of March 2012, focusing on an examination of legal claims based on emotional distress where a party reportedly suffers nervous shock from witnessing a traumatic event. Intentional torts and British common law are addressed, along with the Victoria, Australia Court of Appeal case Carter v. Walker which deals with alleged police brutality and a claim for emotional damages.
