Damages for patent infringement in China.

The article focuses on the determination of damages for patent infringement in China. It discusses the objectives of damages in compensating the patentee for past infringement and to have a deterrent effect upon potential infringement. It further discusses that damages should be determined using several methods including actual loss of the patentee, profits earned by the defendant from infringement and one to three times of a reasonable licensing fee in pursuant to the Chinese Patent Law.
