Abstract

The article discusses globalized litigation and the increasing need for U.S. courts to decide questions of foreign law in light of the application of a plausibility of pleading standard in U.S. courts. Several civil cases are cited, including the U.S. Supreme Court cases Ashcroft v. Iqbal and Bell Atlantic Corp. v. Twombly. These cases are noted for the court's decision to disregard notice pleading in civil litigation matters in favor of the heightened standard of plausibility of pleading.
