Abstract

One year after its entry into force of the Act concerning the regulation of the Consensus in criminal proceedings, defense lawyers and criminal law scholars were invited to discuss the impact this law has had on the practice of criminal proceedings and the understanding of criminal law in general. Consensus does not mean so much unanimity, but rather a compromise grounded on reciprocal agreement that views all parties as adequate. Keller described the consensus of the participants, Kempf explained that consensus could also be created in the case of Nolo Contendre of the accused person, Hamm spoke of a reciprocal exchange of ideas of the objective.
