Abstract
- The article examines liability provided by the Oil Pollution Act and its existing law and necessary revisions in the U.S. It outlines the development of federal liability standards. It summarizes the existing liability provisions of the Act and proposes solutions to the problem areas in oil spills. The Act's weaknesses such as insufficiency of provision for attorney fees recovery, statutory limits on the liability of responsible parties, and inadequate claims procedures are also identified.
