Abstract
- The article discusses the aspects of Section 11.4 Companies' Creditors Arrangement Act (CCAA) which has evolved before the American and Canadian Courts. It suggests that section 11.4 CCAA should be interpreted and applied by the Canadian Courts to force critical suppliers to continue to provide goods or services to the restructuring debtor without allowing the payment of pre-filing debts. It also provides the experience of both U.S. and Canadian on the critical supplier doctrine.
