Abstract

As an important institution in Chinese legal history, inquisition by torture is strictly regulated by lu and li in Tang and Ming Dynasty, including the procedure and conditions of torture, types and standards of instruments, restriction and punishment for torture, etc. Although the institution of inquisition by torture in Ming Dynasty took the rules in Tang Dynasty as a model, there were several differences on legislative technique, torture methods and evidence institution. This is not only a reflection of conflict between abuse and restraint of torture but also an embodiment of entanglement of moral sympathy and lawful violence in despotism. [ABSTRACT FROM AUTHOR]
