Abstract

The article discusses the application of French law regarding fraudulent bankruptcy in the region of Languedoc during the 18th century. The article describes the legal tradition of Faillitus ergo fraudator and its origins in Roman law, the 1673 order to punish fraud through capital punishment and its effect on 18th century administration of justice, and the tendency of parties to negotiate outside the trial system in cases of fraud and bankruptcy. Other subjects under discussion include the Parliament of Toulouse, the Bourse des Marchands, and the characteristics of French commercial law in the 18th century.
